Messaging Policy

La VoiceAI is committed to protecting consumers and ensuring all communications are compliant with regulations. Our messaging policy is based on the following core principles:

  1. Opt-In Messaging Only: Messages are only sent to individuals who have given explicit consent.
  2. Regulatory Compliance: Adherence to all applicable laws, including those governing communication, such as SOC 2, HIPAA, and PIPEDA.
  3. Appropriate Messaging: No hateful, illegal, or inappropriate content is permitted.
  4. Spam and Abuse Prevention: Ensuring all users are protected from spam and abuse.

Messaging Classification

All messages sent via La VoiceAI are considered “Application to Person” (A2P) messages, whether through phone numbers, social platforms, or other channels.

Consent & Opt-In

Proper consent must be obtained before sending messages. Purchased or transferred lists are prohibited. You must maintain records of consent and follow all relevant regulations for record-keeping.

Consent Scenarios

  1. Contact Initiated by Individual: When a person reaches out, you may respond to their inquiry.
  2. Informational Messages: Messages related to prior interactions or relationships, such as order confirmations, are permitted but must not promote additional products or services.

Identifying Yourself

La Voice Ai will not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our services, including any loss of revenue or data.

Opt-Out Mechanism

All initial messages must include instructions on how to opt-out, such as “Reply STOP” or “Reply Unsubscribe.” You are responsible for honoring all opt-out requests across channels.

Managing Opt-Ins and Opt-Outs

La VoiceAI provides tools to manage consent statuses across email, phone, and SMS. These tools help ensure that you do not send messages to users who have opted out.

Disallowed Content

Content must comply with all applicable laws, including but not limited to prohibitions under:
the SHAFT Act, SESTA Act, FOSTA Act, and TCPA. Illegal, hateful, or misleading messages are strictly forbidden.
You are required to comply with all rules and regulations regarding illegal content. These rules may be based on where the message sender or receiver lives or currently is. Some examples of illegal and disallowed content include;

  • Anything illegal in the jurisdiction of the message sender or recipient
  • Anything prohibited in the Sex, Hate, Alcohol, Firearms, and Tobacco Act (SHAFT Act)
  • Anything prohibited in the Stop Enabling Sex Traffickers Act (SESTA Act)
  • Anything prohibited in the Allow States and Victims to Fight Online Sex Trafficking Act (FOSTA Act)
  • Anything prohibited in the Telephone Consumer Protection Act (TCPA Act)
  • Anything prohibited in the Federal Trade Commission Act (FTC Act)
  • Anything prohibited in any other laws or regulations that restrict or prohibit content
  • Anything hateful, abusive, explicit, exploitative, or originating from a hate group.
  • Fraudulent or misleading messages.
  • Malicious content, such as malware or viruses.
  • Content designed to evade filters

Industry-Specific Rules

Compliance with rules related to recipient age, industry standards, and geographic laws is required. If age verification is needed, it must be properly handled.

Carrier Rules

La VoiceAI complies with carrier-specific messaging rules, including those set by CTIA and 10DLC, which govern message types and sender identification.

10DLC Campaign Registration

For users sending large volumes of messages, campaign registration with the “Campaign Registry” is required. Registration ensures higher message throughput and prevents spam.

Violation Detection

Any attempt to evade La VoiceAI’s messaging policy or detection mechanisms, including through methods like snowshoeing, is prohibited. Violations will result in immediate suspension of access.

How We Handle Violations

La VoiceAI will work with customers to resolve policy violations but reserves the right to disable or suspend services for serious or repeated violations without notice.
